Hey everyone, just wondering if someone can help me with this type of scenario.
A software company entered into a contract to build a web site for a large Government of Canada Department in Ottawa. The site was to contain 250 interactive pages written in XML. Alas, it was two years ago when the Ottawa IT market was red-hot. The company could only complete 50 by the end of the contract and abandoned the project, claiming that it was impossible to find enough qualified XML programmers to complete the work. They emphasized that it had never contemplated the acute labour shortage when they signed the contract with the Department. The company claimed that the contract had been frustrated. Was the company justified, from a legal point of view, in abandoning the project? Explain with appropriate legal references.
