I highly doubt it's registered- in which case they can't do anything if its copied, and second- since it's a design made for him he can pretty much do whatever with it (in the real world the company would have to buy the rights- but since it's free you really can't do anything about it). The second person can actually go and trademark it and the first person is pretty much SOL. That's the way things go.

It's just common courtesy not to copy other things, ESPECIALLY among friends and if they made the original design for you.

Yes and no. Images once created are infact copyrighted without the need to file anything. The issue is when one is copied and then altered, with at least a certain % changed (can't remember what %) then it is no longer a copyright issue as the user did. If the work was paid for or commisioned then the person that paid for the creation of the piece would own it 100% unless otherwise agreed upon.

The fact here is respect for someone elses work especially for someone that did something for you for free.

Actually you're right. By default designs are copyrighted- but to avoid mishaps and arguments that's why they're registered. And about the % thing- it's derivative work- I don't know the %'s either.

MY bad... Still not a nice thing to do, rather sketchy to say the least. But c'est la vie.

ANY design work that is created, paid-for, used, and published IS copyrighted, whether or not it is registered or not. Deven, I would think that YOUR design is close enough to be considered copyright infringement. All you need to do is change the font and the background color and you should be good.

To think all this could of been avoided if the guy simply asked the creator of his avatar if he could modify it for other uses.

My avatar was created by someone else, though I would never dream of editing it.
